According to Circular 230, tax preparers are not obligated to scrutinize every detail provided by their clients unless there are indications of inaccuracies or omissions. Importantly, a Tax Preparer is distinct from a Tax Advisor and should not be relied upon for tax advice.
The role of a Tax Preparer is governed by the Office of Professional Responsibility (OPR) through Circular No. 230. This regulatory framework sets the standards for individuals engaged in tax administration and the preparation of tax returns. The primary responsibility of a Tax Preparer is to compile the tax return based on the information furnished by the client. While they are expected to identify errors or omissions in the provided data, the ultimate accountability rests with the client. Individuals with a Preparer Tax Identification Number (PTIN) are eligible to become Tax Preparers, but their activities are overseen by the OPR.
